4. Social media posting

SitePost publishes content to third-party social media platforms on your behalf, including Instagram, Facebook, and LinkedIn. When you use SitePost to schedule or publish posts to these platforms, you are solely responsible for ensuring that all content complies with:

  • The terms of service, community guidelines, and content policies of each social media platform to which content is posted;
  • Any platform-specific advertising or promotional content rules, including disclosure requirements for paid partnerships and sponsored content;

You should review the terms and policies of each platform before publishing:

5. Email outreach (Growth Engine)

The SitePost Growth Engine allows you to send email communications to business contacts. If you use this feature, you must comply with all of the following rules without exception:

  1. 1PECR compliance. All email outreach must comply with the Privacy and Electronic Communications Regulations 2003 (PECR). You must not send unsolicited direct marketing emails to individuals (including sole traders and unincorporated partnerships) unless you have their prior, freely given, specific, and informed consent to do so.
  2. 2B2B legitimate interests basis.Where you are sending marketing emails to named individuals at limited companies or other incorporated entities, PECR permits you to rely on “soft opt-in” or legitimate interests as a legal basis, provided that: (a) the communication is relevant to the recipient's professional role; (b) the sender is clearly identified; (c) an easy and free opt-out mechanism is included in every communication; and (d) any opt-out request is honoured immediately and the recipient is suppressed from all further outreach.
  3. 3No unsolicited marketing to individuals without consent. You must not use the Growth Engine to send marketing messages to individual consumers (natural persons acting for personal purposes) without valid prior consent. Purchasing or renting email lists of individual consumers and using them for direct marketing is prohibited.
  4. 4Accurate identification.Every email sent via the Growth Engine must clearly identify you (the sender), must not use deceptive subject lines or “from” addresses, and must include your physical or registered address.
  5. 5Suppression list maintenance. You are responsible for maintaining an accurate suppression list. SitePost automatically records unsubscribes and will not send further outreach to suppressed recipients, but you must not attempt to circumvent this mechanism or re-add suppressed contacts without a valid legal basis.
  6. 6Data protection. Contact data processed through the Growth Engine must be collected and used in accordance with UK GDPR. You are the data controller for the contacts you import. You must have a lawful basis for processing their data and must respect their rights, including the right to erasure and the right to object.

We reserve the right to investigate complaints of unsolicited email, to suspend Growth Engine access pending investigation, and to report serious or repeated violations to the Information Commissioner's Office (ICO).

6. Enforcement

We take violations of this AUP seriously. If we determine, at our reasonable discretion, that you have breached this policy, we may take any or all of the following actions depending on the severity and nature of the breach:

  • 1Warning. Issue a written warning requiring you to remedy the breach within a specified timeframe.

  • 4Account suspension. Suspend your account temporarily, with or without notice, depending on the severity of the breach.
  • 5Termination. Terminate your account and your access to the Service, without refund of any prepaid fees, in accordance with our Terms of Service.
  • 6Reporting to authorities.For serious violations — including but not limited to CSAM, fraud, threats of violence, and criminal harassment — we will report the matter to relevant law enforcement authorities, the Internet Watch Foundation (IWF), or other appropriate regulatory bodies, and will cooperate fully with any resulting investigation.

We reserve the right to act without prior notice where we reasonably believe that immediate action is necessary to prevent harm to users, third parties, or the integrity of the Service. Nothing in this AUP limits our right to take legal action against you for breach of this policy or for any other reason permitted by law.

7. Changes to this policy

We may update this Acceptable Use Policy from time to time to reflect changes in the law, our services, or industry best practice. We will update the “Last updated” date at the top of this page when we do. For material changes we will provide notice via the email address associated with your account or by posting a notice within the Service.

Continued use of the Service after the effective date of any changes constitutes your acceptance of the updated policy.
